what to do if my visa has expired

my visa and my visa has expired for about one year now..
my problem is which city is it ok to go for an exit visa?
i have my 5000rmb fine ready.
all i want is to pay and get the exit visa without being arreested.

also can i return to china with the same passport?

i need advice..

Pack a toothbrush, not for the journey but from the airport to PSB. Do not make a non-refundable travel arrangement.

Best bet contact a visa agency with guanxi and pay them to get you another visa.

You may be better off waiting until things cool down a bit more before even attempting to leave.

This is weird, if you already paid your 5000 RMB fine, presumably at the Andingmen Entry/ Exit Bureau, you would have been issued a 7 day visa (for a small fee, of course), to allow you to leave the country (you need to show them the ticket to actually get that visa).

In the past, there was no problem getting a new visa in HKG to enter China again, on the same passport, now.....who knows?

By the way, you also need to show them your residence registration from thee local police station, which, you will only get with a valid visa.......tough cookies, I know, but it can be done, many of my friends were in a similar position and got it sorted out.

Hi,if you have pay your 5000rmb fine,then you can exit China.But nobody can guarantee you are able to come back to China or not.

By the way,what's ur natonality??

It doesn't matter from where you leave China - you'll be in trouble anyway. The 5000 RMB do not grant you full redemption of an unlimited visa-less stay in China. Your details will be recorded and any Chinese embassy around the world can, if they want, access them. Many people have been refused new visa because they overstayed a couple of days - talk about a year! China, who is concentrating on limiting foregn immigration to highly skilled people, will certainly not be amused about an application by someone who is unable to handle the most basic of legal registration processes, and consciously violated the country's laws and regulations for such a long period.

Sorry that I have no answers (other than quickly go and pay the fine, mashang!), but may I be a bit nosy and get you to share with us how one overstays their visa for nearly ONE WHOLE YEAR????

You also may be looking at some time in the slammer.

Careful with dealing with visa agents who claim they can get you out of such a jam for a fee. They know you're in a tough spot, so they may just squeeze you!!!

I'm curious, too. How do you overstay for one year? I mean overstaying itself isn't a smart idea in any country, but dude, in China, for a year? What happened, where you abducted and forced to slave in a factory?

Ok it is easy to do, happened to me when I believed the company i worked for had made all the arrangements, simply because they told me they had.
I was a bit aggressive, in a nice way, maybe pro active is a better word, went to my local police myself and after a series of meetings it was deemed I had overstayed, [1 year] was actually responsible, [slap on wrist] but the company was negligent and had to pay my fine.
As detailed in another reply, I was then granted a 7 day visa to prepare to leave, left, reapplied and came back a month later. No hassle.
The biggest problem was the bi**ch at Yonghe gong who processed me, she was a real cow despite letters from the police and a written admission from my ex company.
However, given current policy as again another poster said, you might not find it so easy to get back again as I did, 2 years ago. They are extremely fussy now.

Look paying the fine wont sort it .You may be arrested and possibly deported which means you stay in custody until then .Not always very quickly and you pay 5000yuen.You must get in touch with agencies and see what you can do even if they want lots money.Also they may never let you back in with a big black mark against you.
Get in touch with agencies first.Do not just turn up at exit with 500 stuffed in your passport.

I would be inclined to go to my Embassy and see what they suggest.They say they can help people who have trouble or get in touch with some agencies .Money especially in China can sort things and it is who you know.This person should do something pretty soon but i would not go to police.
These agencies have lots contacts and if you havent got any you must pay for help unfortunately

In my most humble opinion, it may be too late for that.

Better bet would be making it to Fujian province.

Go to village Fulin, talk to snake head Mr. Wong aka Dragon Breath (I hear he's good).

Before you know it, you'll be in a container heading back to your home port (by the way, where are you headed?).

Be sure to bore hole in container for breathing.

Bring a couple boxes of Ramen which are good for munching.

Absolutely tough one with regards returning with same passport. But I'm sure his error will be in the system, so a new passport may not work either. Unless he goes the ridiculous length of getting his name changed. Of course now with face recognition tech... well there's always the possibility of plastic surgery like the boys in Colombia...

But of course he;s got to be able to leave the country before any of that happens.

So obviously he's gotta go to the PSB right now. Say sorry (duibuqi). A few kowtows (the kind where he repeatedly hits his head on the ground making a thud sound until bloody).

But seriously, he needs to act now. And show remorse.

If he has a good reason for why he overstayed, I'm sure the PSB will cut him some slack. Bottom line: Be polite and show remorse. And don't act arrogant.

Two suggestions: 1)Be thankful your not Chinese and in the US or most of western Europe, you'd be looking at serious problems. Jail until deported and permanent ban on reentry. 2) Learn from this lesson.

I don't understand why Laowai think they have the right to hang out in China and then expect any sort of concession from the government. It is actions like this have lead the the government cracking down on visas, making it harder for those of us who follow the law to do business in China.

been here for a couple of years....years ago they wanted us all to come in (educated and uneducated) and the chinese were putting smiles on their faces and said Huan Ying...'come to china ...make us prosperous and international...its a paradise.' We all love you...help to build up china ..we really appreciate and we want you to spend your life here.

Now that we have made it more international and have invested time , effort and money into this hellhole they just want us out 'whenever' they feel its right. Foreigners are not hookers.

They are tightening the visa reg. and pointing to other countries...well, first of all in other countries visa regs dont change monthly...and citizens have rights ...in BJ i have been ID checked for no reason many times( 2ndring road )...if they would do that in europe ( random checking without reason) 75 % of the chinese would have to come back to china...as they are all illegally staying there...

Chinese visas are available to everyone at anytime provided you have enough cash...at the visa office they say its'impossible' ...but actually allthey want is to get you to the 'agents' that are basically giving them even more money...
at the end of the day even gov. office people want their kids to go to harvard or to the local international school

Hi Xman,

I have a friend here who was even in a worse situation than you because she was overstayed for almost two years and what she did was she went to the PSB office and confessed that her visa expired for 2 years so they sent her directly to jail but before you go to PSB you should inform your embassy that you are going there and some friends so at least they know where you are. Then, she was asked to pay 5000K for the penalty and it took her a month to settle everything until she was able to buy a plane ticket. There was also one in Inner Mongolia overstayed for a year and the school she was working was raided and she was caught in the act teaching with an expired Visa for 1 year and she was sent to jail, had to settle everything then she was sent back home. The only thing is prepare enough money for any stuff they would probably ask. I wish you good luck and I hope you can settle this the soonest possible. Maybe it's easier now that Olympics is over.

I had the same experience last year... well, almost the same. My visa was expired for like half a year then I went to the PSB. I told them that my grandfather was really sick and I needed to leave BJ ASAP and I told them that i totally forgot that my visa has expired and that i only found out about it when my family called about my granddad. The PSB asked me to pay the 5000rmb and even helped secure my exit visa for less time than it normally requires. Bottomline, I got home. Im not sure about the blacklist part though, I haven't tried to go back to china this year. but i hope my advice helps.
